Communication and contracting

You are accepting the terms and conditions below also in an implied way, e.g. by continuing in communications or other interaction with DELTA legal after this notice without any express reservation.

Our messages together with any files transmitted with them may be confidential and may contain legally privileged information, and may be used solely by the individual or entity to whom they are addressed. If you are not the intended recipient, please delete such message, including all copies and attachments, from your system immediately and do not use it in any way. You are hereby notified that any use of messages, that are not intended for you, is prohibited, including direct or indirect disclosure, copying, printing, distribution and/or taking any action in reliance on the contents of such messages. If you have received the message in error, please proceed in the same way and notify the sender immediately.

WARNING: Computer viruses can be transmitted via e-mail. DELTA legal cannot guarantee that e-mails and any files transmitted with them are free of computer viruses, you should therefore check them yourself. In case e-mail communication is a part of contract negotiations, you are hereby notified that:

  • we reserve the right to terminate such negotiations at any time and for whatever reason;
  • the contract will not be executed until the parties reach a full agreement on all terms and conditions;
  • acceptance of contract offer with any deviation or reservation is excluded;
  • in DELTA legal, conclusion of any contract is subject to internal rules; contract acceptance cannot be reasonably expected by any party before relevant internal procedure takes place.

You are further notified that in any matter where we act as legal representatives:

  • any communication regarding contracts by DELTA legal is not binding and;
  • DELTA legal is not entitled to conclude the contract on behalf of the client (excluding the case when we expressly inform you in advance that we were empowered to conclude the contract by electronic means of communication and you receive a copy of the relevant Power of Attorney; in cases when we represent the client in contract conclusion, we insist on agreement in written form, with the exception of an email containing all required contract information in non-editable attachment or in pdf form so that the contract can be concluded by a simple and unconditional acceptance by the other party, again recorded in a non-editable attachment or in pdf form);
  • contract conclusion can be subject to client´s internal rules; contract acceptance cannot be reasonably expected by any party before such internal procedure takes place and the contract is approved by the client.

The processing of your personal data – e-mail, address, name and date of birth – for Legal newsletter subscription purposes is based on the freedom to give consent pursuant to Article 6 (1) a) of the GDPR. By subscribing to our Legal newsletter, you give to us as personal data administrators your consent to process your data as follows:

I hereby give consent to the processing of my personal data – e-mail, name, date of birth – which I provided to the administrator DELTA legal, advokátní kancelář s.r.o. for the purpose of sending the Legal newsletter. This consent to the processing of my personal data is voluntary and I may revoke it at any time without needing to state a reason by unsubscribing with effect for the future.

By giving your consent, you also acknowledge the following information about the processing of the above-mentioned personal data:

  • The administrator may provide your personal data as part of occasional marketing campaigns to other beneficiaries, namely professional and specialized agencies, where a high level of protection and use only for Delta legal purposes will be guaranteed;

By submitting the filled in contact form, you give us as the personal data administrators consent to process your data as follows:

4. Acquisition of photo, video / audio recording of lectures, webinars, client breakfasts and similar events (also online)

Making records for intelligence and reporting purposes is possible even without your permission based on Section 89 of the Civil Code. The processing of your personal data contained in them – the recording of your appearance or voice – is also based on our legitimate interest in the further promotion of these events according to Article 6 (1) (f) of the GDPR, especially on social networks (LinkedIn and others) and on our website (blog). Without your consent, we will not explicitly identify you (e.g. state your name), but it cannot be ruled out that someone will recognize you on the record, or that you will be machine-identified by the relevant social network, e.g. if you have enabled it with your preference settings. If you do not agree with the acquisition or publication of records concerning you, please inform us as soon as possible.

Please note the following information about the processing of the above personal data:

  • Your personal data may be provided by the controller as part of occasional marketing campaigns to other recipients, to professional and specialized agencies, which will be guaranteed a high level of protection and only for the purposes of DELTA legal;
  • If your personal data is used for promotion, it will be processed as long as the relevant contribution is accessible according to the rules of the relevant social network or placed on our site and after this promotion period deleted. Otherwise, they will be deleted immediately after the evaluation of the event;
  • Your rights as a data subject are set out in point 5 of this document below.

5. Rights of data subjects

As a data subject, you have the following rights according to the GDPR:

  • Right to obtain free information about processed personal data;
  • Right to access the processed personal data and right to correct them in case of incomplete/inaccurate personal data;
  • Right to delete the personal data and right to restrict their processing;
  • Right to request an explanation if you think that the processing of your personal data is contrary to the protection of your personal life or to the laws and the right to request the removal of a defective condition.

You can exercise your rights with the administrator by e-mail sent to office@deltalegal.cz. Should you suspect a breach of the GDPR provisions by the administrator, you have the right to file a complaint with the Office for Personal Data Protection of the Czech Republic – www.uoou.cz.

6. Security of personal data

To prevent the risk of manipulation, loss or misuse of your personal data, we have adopted reasonable technical and organizational measures, which are checked and updated regularly.
